Welcome to Pilates by Daphne (owned and operated by Lithe Active). By using this website and booking our services, you agree to the following Terms and Conditions. Please read them carefully.
1. Introduction
This website is operated by Pilates by Daphne, owned by Lithe Active. Throughout these Terms and Conditions, the terms “we,” “us,” and “our” refer to both entities. By accessing our website or booking our services, you agree to be bound by these Terms.
2. Eligibility
You must be at least 12 years old to use our services. By booking an appointment, you confirm that you meet this age requirement or have parental/guardian consent if under 18.
3. Services and Merchandise
Our services include private and duet Pilates classes, which can be booked through our appointment system. Packages are available and are subject to additional terms that will be provided at the time of booking. We also offer merchandise for sale through our website.
4. Booking and Purchase Policy
Bookings must be made through our appointment system. No walk-ins are accepted. Merchandise purchases can be made directly through our website.
5. Cancellation and Rescheduling Policy
Cancellations must be made at least 24 hours before the start of the session. Any changes or cancellations to scheduled appointments made within 24 hours may be considered late cancellations, resulting in one session being deducted from the client’s account.
Clients may waive the late cancellation fee up to two times per calendar year for unforeseen circumstances, such as family emergencies, last-minute work meetings, or sudden illness, without needing documentation. After using the two waivers, any further late cancellations will require supporting documentation, such as medical notes or official letters. It is important to note that waivers cannot be applied to cancellations made after the two waivers have been exhausted within the same year, and routine schedule changes or personal preferences do not qualify for a waiver.
6. Non-Refundable Policy
All sales are final. There are no refunds or transfers on any purchases, except in cases of medical unfitness to participate in Pilates, which requires a document issued by a licensed healthcare provider indicating that the individual is unable to participate due to a medical condition or injury.
7. Payments
Payments are not processed online. After booking an appointment, you will receive a message with payment instructions. We currently accept bank transfers or DBS PayNow.
For merchandise purchases, payment must be made online via credit or debit card at the time of purchase. We accept major credit and debit cards including Visa and MasterCard. All card transactions are processed securely through our payment gateway.
8. User Responsibilities
- Arrival Time: Clients must arrive at least 5 minutes early for their appointments to complete any necessary paperwork and prepare for the session.
- Reading Terms and Conditions: Clients are responsible for reading and understanding the Terms and Conditions before booking any services.
- Health and Safety: Clients must inform the instructor of any health issues, injuries, or concerns before each session. It is the client’s responsibility to listen to their body and stop if they experience any discomfort or pain during the session.
- Personal Belongings: Clients are responsible for their personal belongings during sessions. The studio is not liable for any lost or damaged items.
- Hygiene and Cleanliness: Clients are expected to maintain good hygiene and cleanliness during sessions, including wearing clean attire and using provided cleaning materials for equipment.
- Respect for Others: Clients must respect other clients and instructors, maintaining a positive and respectful environment during sessions.
- Payment and Cancellation Policies: Clients are responsible for adhering to the payment and cancellation policies outlined in these Terms and Conditions.
- Equipment Use: Clients must use equipment responsibly and follow instructions provided by the instructor to avoid injury or damage.
9. Liability Waiver
By participating in our classes, you agree that Pilates by Daphne and Lithe Active are not liable for any injuries or adverse outcomes. Please consult a healthcare professional before beginning any fitness program.
10. Privacy Policy
We collect and handle personal information as outlined in our Privacy Policy, which can be accessed here.
11. Reminders and Notifications
We send reminders to ensure smooth scheduling and package management:
- 7 days before package expiry
- 48 hours before an appointment
- When only 1 session is left in a package
12. Intellectual Property
All content on this website, including text, images, and branding, is the property of Pilates by Daphne and Lithe Active. Unauthorised use is prohibited.
13. Changes to Terms
We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting on this website. Please check back periodically.
14. Governing Law
These Terms and Conditions are governed by the laws of Singapore. Any disputes arising under these terms shall be resolved exclusively in Singapore.
